Acceptance of Terms

By accessing or using Khawao ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

These terms apply to all users of Khawao, including customers, restaurant partners, and delivery personnel.

Use of the Platform

You may use Khawao only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the platform in any way that violates applicable laws or regulations
• Place fraudulent, fake, or malicious orders
• Harass, abuse, or harm restaurant staff or delivery personnel
• Attempt to gain unauthorized access to our systems
• Use automated tools or bots to interact with the platform
• Impersonate any person or entity

Account Registration

To place orders, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Keeping your password secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or are used fraudulently.

Ordering & Payments

When you place an order through Khawao:

• You are entering into a contract directly with the restaurant, not with Khawao
• Khawao acts as a marketplace platform connecting you with restaurants
• Prices displayed include applicable charges as set by the restaurant
• Delivery fees are calculated based on your distance from the restaurant
• Payment confirmation does not guarantee order acceptance; the restaurant must confirm

For mobile payment methods (bKash, Nagad, Rocket), you must send payment to the restaurant's number and submit your transaction ID. Khawao does not process these payments directly.

Cancellations & Refunds

Regarding order cancellations:

• You may edit or cancel a PENDING order before the restaurant confirms it
• Once confirmed, cancellation is subject to the restaurant's policy
• Refunds for mobile payments (bKash, Nagad, Rocket) are processed by the restaurant directly
• Cash on delivery orders can be cancelled before delivery without penalty

Khawao is not responsible for refunds; disputes regarding refunds should be resolved directly with the restaurant. We may mediate in exceptional circumstances.

Restaurant Partners

Restaurants on Khawao are independent businesses. Khawao does not:

• Employ restaurant staff or delivery personnel
• Prepare, handle, or deliver food
• Guarantee the quality, safety, or accuracy of food items
• Bear liability for food allergies or dietary restrictions

Always inform the restaurant of any allergies or dietary requirements when placing your order. Khawao recommends checking with restaurants directly for allergen information.

Delivery

Delivery is provided by the restaurant's own delivery personnel:

• Estimated delivery times are approximate and not guaranteed
• Delivery is subject to restaurant availability and coverage area
• You are responsible for ensuring your delivery address is accurate
• Khawao is not liable for delays caused by traffic, weather, or other external factors

Intellectual Property

All content on Khawao — including logos, design, text, and software — is owned by or licensed to Khawao and is protected by intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

Limitation of Liability

To the fullest extent permitted by law, Khawao shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data or business opportunities
• Food quality issues or health-related incidents
• Delays or failures caused by third parties
• Unauthorized access to your account not caused by our negligence

Our total liability to you for any claim shall not exceed the value of the order in question.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangladesh. We encourage you to contact us first to resolve any issues amicably.

Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date and, for material changes, notifying you by email.

Continued use of Khawao after changes take effect constitutes your acceptance of the revised Terms.
